Ordinance No. 1834 

An Ordinance Repealing LCMC 1997, As Amended, Sections 2-1341 Through 2-1345; And Adopting An Ordinance Providing For The Conveyance Of Water Rights Or Project Water Rights Or Authorized Alternative Upon Development.

  • Conveyance of Water Rights or Project Water Rights is a Prerequisite for Development of Land. Each landowner or developer shall convey surface or ground water rights or Project water rights to the City at the time of development. This conveyance requirement shall be in addition to any other development requirements that may be imposed by the City.

  •  
  • Conveyance of the Project water rights allotment is a prerequisite for development of land inside the EBID boundaries. Each landowner or developer of land to be developed shall convey to the City at the time of development the entire allotment of Project water rights appurtenant to the land.


  • The Landowner or developer of non-water righted land may, in lieu of conveying water rights or Project water rights to the City, pay to the City a sum of money which will enable the City to acquire water rights or Project water rights


  • Conveyance or payment in lieu of conveyance shall be made prior to the development.
