Public Liability of the City of Las Cruces

The Risk Management Section administers a self-insurance program for public liability risks, which is supplemented by purchased excess liability insurance policies. This section provides investigation and settlements of small claims arising from the City's operation as a municipality and services to the public. The Risk Management Section also ensures the public interests are protected with appropriate insurance policies and recovery of damages to City assets caused by individuals and outside agencies.

All claims against the City of Las Cruces must be made in writing using the Liability Claim Form and be completed in accordance with the attached instructions. The form must also be accurately completed, printed, and signed by the claimant and mailed, faxed (575-528-3679) or personally delivered to the Risk Management Office at: Suit 126, 680 N Motel Blvd, Las Cruces, NM 88005.

Please allow 30 days for the Risk Management Office to process and investigate your claim. Be advised that the City is prohibited from providing legal advice. Claimants should consult an attorney as needed.

Following the receipt of the liability claim the Risk Management Office will:

  • An investigation will be conducted.
  • Claims are normally processed within 30 days after the receipt of the claim form. When filling out the form please be as accurate as possible and provide the required estimates.
  • Ensure written justification for the amount claimed is indicated on the form:
    1. Property damage claims require 2 estimates.
    2. Personal injury claims will require the claimant to sign a medical release so Risk Management can receive the medical billings from the treating Doctor and/or medical facility.

Following the receipt of the rusty water claim the Risk Management Office will:

  • Investigate the claim.
  • Claims are normally processed within 30 days after receipt of the claim form.
  • Ensure estimates for losses are justifiable and accurate.

Instructions for filing a claim aganist the City of Las Cruces

  1. COMPLETE the Notice of Claim Form. (Please submit your original copies for verification).
  2. Attach two (2) estimates for the cost of damage.
  3. Attach a copy of the police report if one was filed with the Police Department.
  4. Attach any other supporting documentation.
  5. Return to: City of Las Cruces OR Mail to:
