Assistance For The Disabled
The City of Las Cruces is committed to providing
residential solid waste assistive services to residents who have
a disability and who are unable, and have no other individual living
in the residence, to place their refuse container at the curb for
pick-up.
Below you will find the City's policy and an application for assistive services.

Curbside Exemption Policy
Eligibility
Any resident who is physically or mentally unable to place their refuse container
at the curbside, as certified by a physician who is licensed to practice medicine
in the United States, and having no one in their home who can assist them, may
apply for a waiver from curbside refuse pick-up.
No resident will be granted a waiver who has an individual living in the household
who is capable of delivering the refuse container to the street.
Applications for Waiver
Residents applying for a waiver must complete a Department
of Solid Waste Application for Residential Disabled Trash Service
form and submit the application to the following:

Residents applying for a waiver must provide a statement,
signed by a physician who is licensed to practice medicine in the
United States, certifying the resident's inability to place their
trash containers at the street.
Applicants for waiver must be renewed annually by September 1st.
Review of Applications
Applications for waivers will be reviewed by the Director
of the Department of Solid Waste or his/her designee. Residents will
be notified in writing of action taken on the application.
Any resident who is denied a waiver by the Department of Solid Waste has the
right to appeal to the ADA Advisory Board. Appeals may be in-person or in writing.

To appeal in-person, the resident may attend the
ADA Advisory Board Meeting. Check the Public Meeting Schedule
for the date and time of the Advisory Board meeting.

The ADA Coordinator will present all appeals to the
ADA Advisory Board at the next regularly scheduled meeting. Residents
will be notified in writing of action taken by the ADA Advisory Board.
Individuals who no longer qualify for the waiver are required to notify the Department
of Solid Waste by letter addressed to:
